Will Canada provide safe haven to the Indian techies ‘Trumped’ by H-1B visa?


Many H1B Applicants are from India, followed by China and France. President Trump has made the norms for the H1B visa very strict and it is estimated that around 500,000 to 750,000 Indian IT professionals and visa holders may have to depart from the USA soon.

Equally important, is the fact that the drive launched by President Trump has raised grave concerns in India and is expected to impact on the Indian economy seriously. Moreover, as a counter to this strategy, Canada has launched the new Global Skills Strategy. Its government is planning to speed up its visa issuing system and reduce the target for processing the applications of ten business days. Previously it took several months for the same process to end.  2,000 workers had entered Canada as of September 30 in the recent program when it was introduced on June 12. Again, the question here is that can the H1B visa holders from India expect a safe haven in Canada? In Canada already 320,000 newcomers were welcomed last year, owing to the liberal ideology professed by the Trudeau administration.

Dramatic effect on H-1B visa holders

The changes proposed would affect Indian nationals, and cause a major catastrophic impact. Several aspirants have waited for green cards for a long period of a decade, and have US-born children, besides owning a home.  It is estimated more than a million H1-B visa holders wait for Green Cards in the country.

Currently, the law permits the administration, to extend the H1B visas for the immigrants, beyond the three-year terms, twice, when a Green Card is pending.

A source close to the Homeland Security officials disclosed that the idea was to create self- deportation process, for Indian tech workers in the USA, and open the jobs, left by them, to the Americans.

Owing to these proposed steps, regarding the H1-B visa holders, EB-5 visas have appeared as an ideal solution for the Indian families who seek Green Cards. Under this program, a Conditional Green Card is issued to an applicant on making an investment of $5, 00,000 in the USA. Also, there is a provision for creating ten jobs for US citizens. When these provisions have complied, a Permanent Green Card is issued.

Facts about H1B visa

The H1B visa is an employment-based (non-immigrant) visa category meant for temporary workers which permits the US companies to recruit overseas workers. Correspondingly, the USA allots 85,000 new H1B visas every year and all the recipients receive the permission to stay up to six years. The demand is higher every year and the government holds an annual lottery. It is estimated that around 70 percent of such visas are received by Indians and most of the persons are hired by IT multinational companies.
